Judicial politics and the ECJ
Rational - choice institutionalists about the EU judicial politicus and the role of the ECJ in the integration process:
Geoffrey Garret claimed that the Court will be following the wishes of those most powerful members of the EU. These states established ECJ to make sure if there is some incomplete contracting it will be solved by the Court along with their wish(in a long term - even if some small problems will be solve against their will).
Others said that he overestimated that control mechanism of powerful states and that ECJ is more autonomous that Garret said.
Recently, from studying the relationship between ECJ and powerful members, scientists study it's relationship with national courts(that bring many cases before ECJ) and also individuals(they wanted to achieve their goals within their national law system).
